As an employer, it is your responsibility to protect the best interests of your business and of your remaining employees. Former Employees Charging Wrongful Termination Often Seek a Scapegoat Generally, an employee who is fired is angry, unhappy, and looking for someone to blame when his or her employment ends. The employee must face questions and concerns from family members and friends, who may never have been informed that the employee was experiencing performance problems and performance coaching at work. Nor does the average employee come home and share all of the mistakes she has made or the problems he is experiencing with performing his work or carrying out his responsibilities. Sometimes, employees even delude themselves into believing that, while performance issues have been drawn to his attention, they are not that serious. In fact, normally an employee will hide his or her performance problems from family members. It allows the employee to save face, make excuses, and generally, deny responsibility for their ultimate employment termination. It leaves family members more surprised than the employee  if the employee is honest with himself  when employment termination occurs. So, family members and friends tend to believe that the big, bad employer was the enemy and the problem. This support fuels the thinking and feelings of the already upset employee who no longer has a job. Employers are not generally faced with wrongful termination charges that will find them liable unless their actions are illegal. No matter how much the termination may feel unfair or unwarranted to the employee, or his family members, that does not make the employment termination either illegal, unwarranted, or wrong. Employers, in most states, adhere to employment at will standard in which the employer has the right to fire an employee and an employee has the right to quit his employment- at will. for no cause or any reason at all. Considerations to Avoid Wrongful Termination Charges Employment termination becomes wrongful termination under these narrow circumstances. (These are not complete, but do list the most commonly considered possibilities.) Breach of contract: the employer has a legal obligation to uphold all components of an employment contract, union-negotiated or otherwise. Most employment contracts have employment termination clauses which the employer must honor.Breach of implied contract: the employer must take care that the company does not imply in writing or verbally that employment is protected or guaranteed or that any other non-contractual obligations exist. It is why most employers ask employees to sign off on an employee handbook statement that states that written company documents offer guidelines, not a contract. Breach of covenant of good faith and fair dealings: the terminated employee can try to prove that their termination was unfair and that an employer did not fire him for good cause, in some states. It is extremely difficult to prove if an employer has kept even a modicum of documentation about an employees performance problems and managerial counseling and coaching. Terminated employees will generally find that employment at will is the more significant deciding factor.Unlawful discrimination: employment discrimination is illegal. Former employees must file a suit with the Equal Employment Opportunity Commission (EEOC), and perhaps their state civil rights commission, before charging an employer in court. An employer protects their organization from such charges by practicing strict care to avoid employment discrimination  or the appearance of employment discrimination, for any reason. For example, in a layoff situation, an employer must demonstrate non-discriminatory reasons for why each laid-off employee was selected. Laying off all members of an eliminated department, or laying off the 10% of all employees with the least seniority, may keep employers safe from discrimination charges. Employers should seek legal counsel at their first indication that a former employee intends to press some form of wrongful discharge contentions. It will normally occur either in conversation, emailed correspondence  or with the failure of the former employee to accept and sign off on their employment termination agreement or severance package. Sometimes, however, an employers first inkling of a problem occurs when a fact-finding package arrives from state or Federal discrimination agencies. Even if the employer is crystal certain that their handling of the employment termination was legal, ethical, and appropriate, legal counsel is more experienced in wrongful termination situations than the average employer. To do this, we conducted a comprehensive eye-tracking study of recruiters while they reviewed resumes.If you’re not familiar with eye tracking, it’s a line of research that uses technology to record and analyze where and how long someone focuses when digesting a piece of information or completing a task.We brought in recruiters and recorded them as they viewed online profiles, different types of resumes, and other forms of candidate information.Here’s some of what we discovered:How much time does a recruiter spend reviewing a resume?Unfortunately, not much. Most job seekers think recruiters spend 4 to 5 minutes reviewing a resume. The truth: recruiters spend about 6 seconds before they make the initial “fit/no fit” decision. That means prioritizing information is essential.Does a professionally written resume make a difference in what a recruiter learns about the candidate?The results of the study revealed that the recruiters were able to easily find and focus on the important information they were looking for in a professional resume much faster than regular resumes or an online profile.Are online profiles effective?No. Online profiles have pictures, and unfortunately, recruiters tended to focus on them for the simple reason that pictures naturally draw the eye. We regularly talked about our weekend plans, helped each other out with tough assignments, and vented to each other about office drama. She was a great co-worker, and we worked together flawlessly. Then, one day, everything changed- she become my manager. In a swift department shift, she was promoted, and I become one of her direct reports. If you’re ever in the same situation, it can be hard to fight through the range of emotions you’re feeling- everything from being proud of your co-worker to wanting to rip that lofty title right out of her hands. But to make the move successful for everyone involved, you need to do these key things. Quell the Jealousy I know what you’re thinking: It’s not fair that your co-worker got the promotion, you deserve to be the manager, he or she gets an office while you’re stuck in a tiny cube, and he or she probably got a giant raise. I know, because I thought those things, too. It’s going to be hard to face your co-worker’s new managerial position without at least a twinge of jealousy. No matter how happy you are for him or her or how great the two of you get along, a little envy is inescapable. But get those thoughts out of the way now, because at the end of the day, this is the situation you’re in, and jealousy won’t change it. With the right attitude, you can use that jealousy in a healthy way to benefit your career- but don’t let it get in the way of your success in your company and under your new manager. Be a Little Selfish As I’ve mentioned, in this new situation, your thinking is probably already on the selfish side. Rather than thinking about how wonderful it is that your friend got a promotion, for example, you’re probably feeling sorry for yourself and your inhibited work friendship. Well, good news: I’m here to tell you to continue on that self-centered road and start to consider how your co-worker’s promotion can benefit you. Remember all those things you and your co-worker vented to each other about when you were cubemates? Maybe you thought a department policy was inefficient or that employees should have more flexibility to work from home. Guess what? Now that your co-worker is in a position of power, he or she may actually be able to make those changes happen. I remember complaining to my co-worker that I’d had almost no communication with Rebecca, our chief marketing officer. When that co-worker became my manager, the first thing she said was, “I have a one-on-one meeting with Rebecca today; do you want me to get you some time on her calendar?” And voil- I finally had a direct line of communication to the CMO. Remember: Your co-worker has literally been in your position before- she understands what you want and is now in a position to make that happen. Take advantage of it! Don’t Be So Quick to Judge When my co-worker became my boss, I immediately started looking at everything she did through a tainted lens. She wanted to review my draft before I continued with a project? Obviously, she was a micromanager. She started assigning me projects and reminding me of deadlines? Clearly, she was on an out-of-control power trip. In the heat of the moment, it can be easy to perceive certain events or behaviors in a skewed way. But let’s be realistic: As a manager, doling out assignments and reviewing her employees’ work is part of her job. All she’s doing is stepping up to her role and doing what’s expected of her- and you can’t blame her for that. Instead of intentionally looking for things to blame her for, give her the benefit of the doubt. Wait to see how things play out. Accept That Some Things May be Different Right off the bat, some things may be different about your day-to-day relationship. For example, my co-worker and I used to vent to each other about Matt, the manager of a department we worked closely with. Whenever one of us had to interact with him, we’d share all the gory details with the other. But once she become my manager- and a peer of Matt’s- she wasn’t quite as open. Now that she was working with him on a daily basis, she had to maintain a good relationship with him, and she realized she couldn’t be speaking down about him to her team. All of a sudden, our venting sessions changed. I sensed that she took her managerial role very seriously, and didn’t want to risk her professionalism by gossiping. That particular element of our relationship simply had to change- but for the sake of my co-worker’s career (and mine), it was probably for the best. …But Some Things Don’t Have to Change On the other hand, it’s important to realize that not everything about your relationship has to change. Maybe, as co-workers, you used to go to lunch once a month. That’s something that doesn’t necessarily have to stop, as long as your co-worker-turned-manager knows how to navigate the sometimes-tricky waters of being friends with employees without playing favorites (and if he or she doesn’t, here are some tips). Yes, you need to be respectful of your co-worker’s new role- but as long as you tread carefully, you don’t have to start your professional relationship from scratch. Embrace That You’re a Team It’s understandably tough to see the working relationship between you and your co-worker change. But as career coach Lea McLeod often says, it’s your job to make your manager more successful. And that doesn’t change just because your boss is your former co-worker. It does, however, make that goal a little easier. So often, employees struggle with figuring out how to work effectively with their managers- how to communicate successfully, disagree respectfully, and ask for help when they’re confused. Well, after working with this person for so long, you should have those things down to a science. And that will make your job much easier. After all, anything that tries to study natural genetic inclinations sounds like it may lean toward eugenics and Social Darwinism - two fields of thought that have grown antiquated with the passage of time, as people have realized that both have racist underpinnings.But the 23andMe research does not seem to wander into problematic territory; in fact, researchers found that the “adherence”  genome-wide association study “did not yield any genome-wide significant hits” (though they noted the analysis was underpowered and might need more responses for interesting results). Without risking stereotyping, it’s safe to say at least some women focus a lot on self-improvement and self-realization, and magazines and other cultural touchstones are constantly telling women how to be better.But though men may make fewer resolutions, they’re more likely to keep them once they do. The same goes for older people - though they’re less inclined to come up with that original goal, they stick with the one they make.Why do some people succeed?Though we’d all like to blame our genetics for our failings, researchers at 23andMe said that “genetic effects we identified here are mild.” They cited influencers such as “picking reasonable goals and having a supportive environment” as other forces that affect whether we see our resolutions through.So instead of resolving to run that marathon after avoiding the treadmill for years, maybe it’s a good idea to go on a 20-minute walk every day.
